Lead-based Paint Activities
"TITLE X":THE RESIDENTIAL LEAD-BASED PAINT HAZARD REDUCTION ACT of 1992 §1001-1061 of the HOUSING AND COMMUNITY DEVELOPMENT ACT of 1992 (Public Law 102-550) §1018 of Title X states the purpose to be: To develop the infrastructure and standards necessary to reduce lead-based paint hazards in housing (defined in Section 1003 of the Act). Congress recognized that lead poisoning is a particular threat to children under age 6, and particularly emphasized the needs of this vulnerable population within various sections of the Act. To promulgate regulations for disclosure of lead-based paint or lead-based paint hazards in target housing (pre-1978) which is offered for sale or lease.TITLE IV OF TOXIC SUBSTANCES CONTROL ACT
TSCA § 402 directs EPA, HUD, the Department of Labor, and the Department of Health and Human Services: To promulgate regulations to ensure that individuals engaged in certain lead-based paint activities are trained, that such training programs are accredited, and that contractors engaging in such activities are certified. To develop standards for performance of lead-based paint activities...detailed reports be written at the completion of any lead inspection or risk assessment, whether voluntary or required. Such reports would have to be disclosed as information known to the seller or lessor under the proposed § 1018 disclosure requirements. TSCA §406 directs EPA: To develop and publish a lead hazard information pamphlet on lead and lead-based paint hazards in the home. |
