Disclosure Requirements found in Title X,

the Residential Lead - Based Paint Hazard Reduction Act of 1992. 

"Target Housing"

This Rule only effects the sale or lease of "Target Housing" - housing built before 1978 when the Consumer Products Safety Commission ordered the phase-out of lead in residential-use paint.

In 1992, Title X directed EPA and HUD to jointly issue regulations requiring that all sellers & lessors of "target housing" must:

  • Disclose known lead-based paint and/or lead-based paint hazards;

  • Reveal any reports of previously conducted lead - based paint inspections;

  • Provide purchasers and lessees with a federally approved pamphlet that describes lead hazards.
